Apple facing an ultimatum, the apple has 90 days to react

This is another blow for Apple. The brand with the apple will have to let third-party applications set up their own application stores. This practice, already legal in Europe, will therefore become the norm in Brazil. The justice system in the South American country has just delivered its verdict. Apple now has 90 days to implement it, otherwise it risks very heavy fines.

In a recent statement, the judge behind this decision explained “Apple has already complied with similar obligations in other countries without demonstrating a significant impact or irreparable harm to its economic model.A statement that concludes nearly 3 years of trials and back and forth before the Brazilian courts.

This whole story began in 2022 with a complaint from Mercado Livre. In November, independent developers had already won a first historic battle. Apple was to allow them to add alternative payment options, thus putting a stop to Apple's 30% commission on all purchases.

Apple wants to appeal

A decision that was finally canceled at the last minute, in December. Since then, the procedures have resumed, and Apple has just received a new, even harsher verdict. The brand with the apple obviously does not intend to let itself be walked all over without moving. It has already announced, through its spokesperson in Brazil, Fred Sainz, that it is appealing this decision.

The Cupertino firm assures that it already has to deal with fierce competition in the market. She specifies that the arrival of third-party app stores is a real danger for the security of users' personal data in Brazil. This argument had already been used by Apple in Europe to prevent the arrival of the DMA, without effect.

Brazil, Apple's new defeat

After having to bend the knee in Europe, Apple risks losing ground in Brazil. The brand with the apple will now have to use its communication to keep its users on the App Store. While these court decisions may seem inconsequential to us, Apple knows very well why it is fighting so hard to keep its monopoly on the App Store on the iPhone.

Thanks to the generous commissions taken by Apple on all in-app purchases, billions of dollars flow into Apple's accounts every year. Money that the company does not want to do without, even if it means having to face all the courts in the world.
